1Acceptance of Terms

By accessing or using OrthoAsk (the "Service") at orthoask.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 14 years old to use the Service. If you are between 14 and 17, you should use the Service with the involvement of a parent or guardian.

2The Service

OrthoAsk is an AI-powered Q&A platform that provides general information about orthodontic topics. The Service includes:

  • AI-generated answers to orthodontic questions, drawing on clinical orthodontic knowledge.
  • Specialist review (currently free) where a licensed orthodontic specialist may review your question and uploaded photos to provide additional informational guidance.
  • Multi-language support in English, Korean, Japanese, and Chinese.

The Service does not provide medical diagnosis, treatment, prescriptions, or personalized treatment plans. All information is for educational purposes only.

3NOT A DOCTOR-PATIENT RELATIONSHIP

Use of OrthoAsk does NOT create a doctor-patient relationship between you and any specialist who reviews your questions or photos. Specialist review on this platform is provided as general informational guidance only, not as a clinical consultation.

For actual orthodontic diagnosis, treatment recommendations, or care, you must visit a licensed dentist or orthodontist in person.

4Your Account

  • You may use the Service as a guest (limited to 5 questions per day) or sign in with Google for additional features (10 questions per day, conversation history, specialist consultation).
  • You are responsible for maintaining the security of your Google account used to sign in.
  • You agree to provide accurate information and not impersonate others.
  • We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

5Acceptable Use

You agree NOT to:

  • Use the Service for emergency medical situations. If you have a dental emergency, call your local emergency services or visit an emergency room.
  • Submit false, misleading, or harmful content.
  • Upload photos that are not your own or that depict other identifiable individuals without their consent.
  • Upload content that is sexually explicit, violent, or otherwise inappropriate.
  • Attempt to bypass rate limits, automate submissions, or scrape the Service.
  • Reverse engineer, decompile, or attempt to extract source code from the Service.
  • Use the Service for commercial purposes (e.g., reselling answers) without our written permission.
  • Use the Service to harass, harm, or invade the privacy of others.

6User Content

You retain ownership of the questions and photos you submit. By submitting content, you grant OrthoAsk a non-exclusive, worldwide, royalty-free license to use, store, process, and display your content solely for the purpose of operating and improving the Service.

We do not use your content to train AI models, and we do not sell your content to third parties.

You represent that you have the right to submit any content you upload and that it does not infringe on third-party rights.

7Pricing and Payments

The Service is currently offered free of charge during our launch period, including the specialist consultation feature. We may introduce paid features in the future, in which case we will:

  • Provide clear pricing before any charge.
  • Update these Terms with payment-related provisions.
  • Give you the option to decline before incurring any charge.

8Intellectual Property

The Service, including its design, code, branding, and content (excluding user-submitted content), is owned by OrthoAsk and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9Disclaimers and Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free.
  • AI-generated answers will be accurate, complete, or appropriate for your specific situation.
  • Specialist reviews will be available within any specific timeframe.

To the maximum extent permitted by law, OrthoAsk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages for delayed treatment, misdiagnosis, or any decision made based on information from the Service.

You acknowledge that you use the Service at your own risk, and that you are solely responsible for any decisions you make about your dental or orthodontic care.

10Indemnification

You agree to indemnify and hold harmless OrthoAsk, its operators, and affiliates from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party rights.

11Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or applicable law. Upon termination, your right to use the Service ceases immediately, but provisions of these Terms that by their nature should survive termination (such as disclaimers and limitations of liability) will continue to apply.

12Changes to These Terms

We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via prominent notice on the Service.

13Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. For users outside Korea, mandatory consumer protection laws of your country of residence may also apply.
